$85M verdict goes Arthrex's way

NAPLES -- A federal judge in Portland, Ore., reversed an $85 million patent infringement decision against Arthrex Inc.

Smith & Nephew Inc., a competing manufacturer in the medical device field, has been seeking damages from Arthrex for eight years over the Naples firm's use of SutureTak and PushLock line of suture anchors. A suit was first filed in January 2004; six months ago, Arthrex successfully appealed a $4.7 million judgment against the company in Texas.

“While we are very pleased with the judge's ruling, we are perplexed by S&N's continued attempt to compete in the courtroom rather than the marketplace,” said John Schmieding, Arthrex' general counsel. “Arthrex would much rather apply its resources towards advancing innovation and life changing technologies.”
