ACLU sues Lee County courts

CAPE CORAL — The American Civil Liberties Union accused the Lee County foreclosure court system of unfair practices today. A petition filed with the state's appeals court argues that the “mass foreclosure docket” method the court adopted at the end of 2008 is unfair.

“The shortcuts taken in Lee County courts mean that homeowners may never have a meaningful opportunity to refute faulty evidence supposedly supporting foreclosure,” argues Larry Schwartztol, a staff attorney with the ACLU Racial Justice Program, in a written statement.

The individual petitioner being represented by the ALCU in this case is Georgi Merrigan, a Cape Coral resident. Because Merrigan's case has become part of the county's “mass foreclosure docket,” she argues her right to a “fair shot” at telling her side of the story has been denied.
